Ganguly said 'you are very beautiful, I am attracted to you': Law intern in her affidavit

NEW DELHI: Excerpts of an affidavit by a law intern, who has accused former Supreme Court judge AK Ganguly of sexual harassment, have been made public in an unusual step by additional solicitor general Indira Jaising, sparking off fresh demands for his resignation as chairman of the West Bengal Human Rights Commission (WBHRC).

In her affidavit to a three-judge panel set up by Chief Justice of India P Sathasivam to go into her allegation that Justice Ganguly had sexually harassed her in a hotel room on December 24 last year, the intern has described in detail his alleged behaviour when she had gone to assist him in his work.

Justice Ganguly has strongly denied the allegations and refused to step down as WBHRC chief.

Jaising said on Monday that she had made the excerpts public with the "full support" of the intern and If Justice Ganguly refused to resign, then the process should be initiated for his removal by the President of India. She has written to Prime Minister Manmohan Singh in this regard.

The ASG said she would like to state "very unambiguously that whatever I am doing, I am doing with her (intern's) complete cooperation and keeping her in the loop and I would never ever make a document like this public unless I had her full support".

She was responding to a question whether she should have gone public with the excerpts when the intern herself has chosen not to do so and neither has she filed a police complaint in this regard.

The intern had given her statement to the apex court panel besides giving to it affidavits of witnesses to whom she had spoken immediately after the incident.

The panel had video-recorded Justice Ganguly's statement in which he denied the allegation of any sexual harassment.

However, the panel had indicted him by holding that the statement of the intern, both written and oral, had prima facie disclosed "an act of unwelcome behaviour (unwelcome verbal/non-verbal conduct of sexual nature)" by Justice Ganguly with her in the Le Meridien hotel room approximately between 8pm and 10.30pm.

In her affidavit, the intern stated that the judge had called her to the hotel room on Christmas eve to complete a report relating to the All India Football Federation.

"The judge informed me that the AIFF report had to be submitted the next morning and asked me to stay at the hotel and work all night. I declined and told him that I had to finish the work quickly and return to the PG accommodation," Jaising quoted from the intern's statement.

At one stage, the judge took out a bottle of red wine. "He also said that since I had had a long day, I should go into his bed room and relax while drinking some wine", the intern said.

The intern said she felt uneasy, unsettled and disturbed by the judge's suggestion.

"You are very beautiful," the judge told her. "I immediately rose from my seat, but before I had a chance to respond to the statement, he caught hold of my arm, saying, "you know that I am attracted to you, don't you? ... but I really like you, I love you. When I tried to move away, he kissed my arm and repeated that he loved me," the intern said.

As pressure mounted on Justice Ganguly to resign, law minister Kapil Sibal said he was waiting to see when the apex court "rises to the occasion" to deal with the issue.

"Waiting to see when and how the Supreme Court rises to the occasion to deal with Justice Ganguly," Sibal tweeted.

His remarks on the microblogging site came days after he questioned the decision of the Supreme Court of not taking further action against Justice Ganguly just because he has retired, saying the issue cannot be "brushed under the carpet".

The allegation against Justice Ganguly was raised in Parliament on Friday with the BJP and the Trinamool Congress demanding his removal as chairman of West Bengal rights panel, saying on ethical grounds he should have resigned by now.

West Bengal chief minister Mamata Banerjee, who had chosen Justice Ganguly as the chairman of WBHRC after coming to power in 2011, has written twice to President Pranab Mukherjee seeking strong action against the former judge.

Samajwadi Party leader Naresh Agarwal said law must be equal for all. "Why cannot a case be filed against the judge? If cases can be filed against politicians and journalists, why not Justice ganguly ? he asked.

CPI leader D Raja stressed that Justice Ganguly should quit from his constitutional position.

"It is better to uphold the judicial prudence and the value in public life. Mr Ganguly has to go," he said.

Woman gives birth to 10 ‘dead’ babies in Madhya Pradesh

BHOPAL: A 28-year-old woman from Satna district of Madhya Pradesh has reportedly broken all the Indian medical records after giving birth to 10 babies at a time, on Sunday late night. But, none survived.

This is said to be the largest ever reported number of fetuses in one womb, at least in India so far as a doctor in Rome once claimed that he has removed 15 fetuses from a woman in 1971.

Anju Kushwaha, a resident of Koti village in Satna was referred to Sanjay Gandhi Memorial (SGM) hospital in Rewa district - located 125km from her village - following medical complications on Sunday evening.

"She delivered nine of them midway. Obstetric and NICU team at our hospital helped her to deliver the 10th one in the operation theatre - all were born dead at almost 12 weeks" said Dr SK Pathak, assistant superintendent of the hospital told TOI.

She reached hospital at around 11pm with her husband Sanjay who was carrying nine premature offspring's wrapped in a piece of cloth. The last one was delivered at around 12.31am.

While there was a long queue outside the maternity ward to have a glimpse of the mother and set of her multiple offspring's, doctors at the hospital decided to submit a new research paper on this particular case of high order multi-foetal pregnancy.

Dr Pathak said that Anju had undergone fertility treatments.

Experts claim that multiple pregnancies like this happen due to over stimulation during fertility medications and assisted reproductive technology (ART).

"It seems that that there was no regular follow-up of her pregnancy after IVF. At least three offspring's could have been saved by reducing the pregnancy," says Dr Sumitra Yadav, a senior gynecologist associated with Maharaja Yeshwantrao Hospital, Indore - state's largest government facility.

Multifetal pregnancy reduction (MFPR) also known as "selective termination could have been done in this case, she said adding it's a procedure used to reduce the number of fetuses in a multiple pregnancy, usually more than three.

"Risks of miscarriage, stillbirth, and lifelong disability increase with each additional fetus. MFPR is usually done early in a pregnancy, between the 9th and 12th weeks. This procedure helps to reduce chances of miscarriage and delivering healthy babies," Dr Yadav added.

Though this is said to be first case in MP, a doctor had reportedly removed 15 fetuses from the womb of a 35-year-old woman in Rome in 1971 as per medical journals. It was the largest reported number of fetuses in one womb in the world. Then, in 1999, a woman in Malaysia also birthed 9 babies, but none survived.

AAP dodges crown of thorns, fends off Congress and BJP with 'tough' terms

NEW DELHI: Post-election politics in Delhi has become a game of one-upmanship with both Congress and BJP attempting to nudge the Aam Aadmi Party (AAP) into forming a government and the new party seeking to dodge what it feels is a trap by setting conditions it calculates neither of the two big parties can accept.

The political chess being played out saw Congress offering "unconditional" support to AAP on Friday and the latter responding by seeking assurances on issues such as an audit of power discoms, rollback of FDI in retail, supply of free water and passage of a "Jan Lokpal Bill".

Chaffing at being bested by a new party their refused to take seriously, both Congress and BJP leaders have been privately expressing the view that AAP should be "allowed" to form a government and calculating that the new outfit would be swiftly discredited once in office.

The hope that AAP will implode is based on the assessment that the newbie has made promises of free water and slashed power rates that are near impossible to deliver. The test of governance will prove AAP's undoing, the big two of Delhi politics seem to feel.

Aware that running a minority government or depending on Congress for outside support is a fraught task, AAP leader Arvind Kejriwal has, in turn, declared that he will expose the "shifty politics" of the national parties and sought to sidestep what he sees as a lure by unrolling a charter of action that embarrasses both Congress and BJP.

AAP seems to be looking for an escape route as it will find it difficult to explain why it has chosen to deviate from its stand that BJP and Congress are two sides of the same coin and any truck with them will sully its image and transparency agenda.

Congress leader Arvinder Singh Lovely promptly slammed AAP for grandstanding, saying the conditions were unreasonable and said most of the 18 issues outlined lay in the domain of executive action, something that does not require support in the state assembly.

Kejriwal sought time from Delhi lieutenant governor Naseeb Jung on Saturday for greater clarity as to the nature of the support offered by Congress, but was quick to point out "Both Congress and BJP are competing to offer support...But what is their intent? I know it is not positive."

AAP has been chary of accepting support or running a minority government, but needs to demonstrate that it is not being stubborn in rejecting office. On the other hand, Congress seems to keen to demonstrate humility in defeat while also setting out a fur-lined trap of the outfit that played a key role in its rout in Delhi.

With Congress and AAP circling each other warily, BJP has said it is willing to sit in the opposition and play a constructive role. "We have not accepted support nor are we going to offer it. The party is willing to let AAP or any alliance between AAP and Congress to assume office without being a facilitator."

The challenge thrown by Kejriwal is intended to set unacceptable terms for Congress as an investigation into power discoms clearly targets former chief minister Sheila Dikshit and suggests wrongdoings by the previous government. So does the pledge to probe graft cases relating to the Commonwealth Games.

"Problems we have listed in our letter are those that have been created by Congress and BJP. It is their people who come under the Lokpal net. Can we still expect support from them? And what is the harm if these issues are clarified before government formation?" asked AAP MLA Manish Sisodia.

Kejriwal shot off letters to Congress chief Sonia Gandhi and BJP president Rajnath Singh, setting out the 18 points and asking if the two national parties are still willing to support AAP.

Despite a slim chance of receiving a positive response, Kejriwal still played safe and said AAP will ask for a public mandate to decide whether it will form government or not.

The assembly arithmetic has made it almost impossible for any party to fish for support. AAP won a stunning 28 seats in the 70-member Delhi assembly, while BJP bagged 32 seats. With just one independent — a BJP rebel — and a lone Janata Dal (U) member, the only other group in the assembly is Congress with eight MLAs.

The LG, who sent a report to the home ministry, told AAP that he is willing to wait. AAP too has set no deadline for Congress and BJP to respond. "It is an open ended offer from us. The ball in their court now. Let us wait and see when and what they say in response to our letter," said Sisodia.

During and after the election, the fledgling party drew fire from its weightier rivals for being a maverick and accused of skirting responsibility of a government formation since it had made lofty promises it was incapable of fulfilling.

"Congress and BJP have been trying very hard to trap us but now it is our turn to expose the shifty politics they play. BJP emerged as the largest party after these elections. They have conveniently washed their hands of government formation. Till the results came out, both parties dismissed AAP as a nobody, called us pests," added Sisodia.

Indian Idol winner Sandeep Acharya passes away

Sandeep Acharya, who won the second season of Indian Idol in 2006, passed away at a Gurgaon hospital on Sunday.

The 29-year-old singer, who hailed from Rajasthan, had been suffering from jaundice for a fortnight. However, he apparently neglected his health and had to be admitted to a local hospital in his hometown, Bikaner, in a critical condition.

When his health did not improve, he was taken to Gurgaon. He breathed his last on Sunday at 9am.

His younger brother, Akshay, said on Sunday, "Last night, doctors said his condition was under control and he was showing signs of recovery. We were all hoping we'd soon take him home. But nobody knew that he would leave us forever."

Acharya is survived by his wife and a one-month-old daughter. His last rites will be performed in Bikaner.

Delhi govt formation: Kejriwal sets terms for Cong, BJP

NEW DELHI: Giving a new twist to government formation in Delhi, Aam Aadmi Party on Saturday set some new conditions for Congress and BJP before it can decide on forming a government, a move seen as attempts to fob off criticism that it was running away from taking responsibility.

Delhi lieutenant governor Najeeb Jung, whom AAP convener Arvind Kejriwal met, has said he will send a report to the President, an indication that he would tell the Centre that government formation will not be possible now.

Earlier, Kejriwal had given to Jung the copies of the letters he had written to Congress president Sonia Gandhi and BJP president Rajnath Singh seeking their views on a list of 18 issues that included ending VIP culture in the capital, audit of electricity companies and removal of MLA local funds scheme.

In a surprise move, Congress had last night extended unconditional support of its eight MLAs to AAP for forming the next government.

Talking to reporters after the meeting, Kejriwal said, he had not sought any time from the lieutenant governor for government formation.

He claimed the LG told him he can come back when he has the majority. However, a press release issued by the LG said, "Leader of AAP legislative party Arvind Kejriwal met lieutenant governor. Referring to the letter of support received from Congress, Kejriwal said he would be in a position to form a government only after ascertaining the views of people of Delhi. The honourable LG will be submitting a factual report to the honourable President of India".

While the single largest party BJP with 31 MLAs had declined to from the government, the second big party AAP with 28 seats has been saying that it would not take from or give support to Congress and BJP in government formation.

18 issues raised in AAP letter to Sonia, Rajnath

The 18 issues pertaining to the common man raised in Aam Aadmi Party chief Arvind Kejriwal's letter to the Congress and the BJP chiefs includes:

1. The VIP culture should be stopped in Delhi. No MLA, minister or Delhi official will use a red beacon on their cars. Neither will they live in big bungalows nor take any special security.

2. Passing of the Janlokpal Bill, the same version for which Anna Hazare held fasts.

3. People will take decision directly in 'mohalla sabhas', which will be held in every locality and colony.

4. The AAP demanded complete statehood status for Delhi. Central government's hold on DDA and Police should end.

5. The party also demanded a special audit of all electricity companies in the national capital from the time these were privatised. The companies that refuse to participate, their licenses should be cancelled.

6. Electricity meters should be checked.

7. There is 220 litres of water available for every person daily. Where is it?

8. AAP wants unauthorized colonies should be regularized. Thirty percent of Delhi's population lives in such colonies and these should be regularized.

9. The party demanded to know if the Congress and the BJP will support its decision to give clean and affordable 'pakka houses' (built up houses) to those living in slums.

10. It also sought their support to give regular jobs to those working on contractual basis.

11. It wants to give infrastructural facilities like roads, electricity, water and basic facilities to the ordinary trader.

12. AAP said it is against FDI in retail.

13. The party wants to provide facilities and subsidies to farmers in the villages in the national capital.

14. The party also demanded to know the Congress and BJP's stand on opening 500 government schools, stopping donations in private schools and making the fee system transparent.

15. The party said it wanted to open new government hospitals with better facilities.

16. It also wants to have special security units for women and wants all harassment cases to be tackled within three months.

17. It wanted to set up enough courts and appoint judges so that all cases are dealt with within six months.

18. The AAP wanted to know whether the municipal corporations of Delhi will support them on these issues.

Sussanne's father Sanjay Khan, however, said it was not the end of the road for his daughter's marriage to Hrithik.

"Like any other normal couple they also have some issues. Just because Hrithik is a superstar, doesn't mean he will not have personal issues.

"They both are intelligent and wonderful people. It's just that they need space. Of course this is not a closure. They respect each other. To resolve issues, may be this is what they thought was good," Khan told PTI.

Sussanne's sister Farah too echoed her father in her tweet: "Sometimes a couple needs space to work things out without the concern others are most keen to show. Everything in this world is as permanent or as temporary as we see it. Would like to request the media/friends to be sensitive to the fact that there are two innocent children involved and no one can predict the future."

Salman Khan changed my life: Mudassar Khan

Choreographer Mudassar Khan on Salman Khan, his new telly outing and more in a chat with TOI

Mudassar Khan who choreographed Dhinka Chika (Ready), Chalao Na Naino Se (Bol Bachchan) and Party All Night (Boss), has just turned mentor and judge for Dance India Dance Season 4. In Ahmedabad for a promotional tour, TOI caught him in an animated mood.

Mudassar says, "People laughed at me when I first danced at a family ceremony in Lucknow. That's when I decided that I had to learn how to dance well. I joined a dance academy in Mumbai because I realized one cannot succeed now without formal training. I struggled a lot initially. For seven years I taught dancing in schools from morning till late night."

He adds, "There was a promotion activity of Wanted in a mall and several teams were competing for the best dance performance. Salman Khan and Prabhu Dheva had declared that the team which won would get a chance to work with them. I went with my team because I am a huge fan of Prabhu Dheva. Luckily, our team won and Salman wanted to meet the choreographer. I went to his place and met him; there was no looking back after that. Now I'm also a big fan of Salman because he's changed my life."

Talking about a new team of judges being in place of Remo D'Souza, Geeta Kapur and Terence Lewis, Mudassar says, "They started with the first season of the show and each year they raised the bar. For us, it is not just about choreography, but also about our personality. They did a great job, we are carrying the legacy forward."

On the reach of television, he says, "People did know me before but they were someone who were associated with dance and the film industry. After the promos of DID 4 went on air, everybody knows me. But after a stage show in Hyderabad with Salman, where I was mobbed by thousands, I sometimes feel it is better if people don't recognize me. I like to roam around on my bike and I've also had someone tell me, 'Aap school me hai? Aapke jaisa hi ek banda TV pe aata hai.' I say 'yes' and move on."

Given his good looks and the funny acts he puts up repeatedly, we ask him if he has thought about becoming an actor. Mudassar says, "I did think about it and even got offers for commercials. But I want to concentrate on dance right now."

Talking about his future projects, Mudassar says, "Right now I want to concentrate on this show. I am also doing the choreography of Salman's next and Salim-Suleiman's album. I stay in a mohalla and hardly get to sleep. Even in the middle of the night I have people stand outside the window and shout - 'ae judge o judge' to harass me. But I have learnt to ignore them. I also have some family issues which I have to solve, and then I'll do other things."
