Robert Vadra case: Allahabad HC issues notice to govt

LUCKNOW: The Allahabad high court's Lucknow bench on Thursday granted three weeks to the Central government in New Delhi for filing objections to the petition that has sought the court's directive to order an investigation into the allegations of corruption leveled against Sonia Gandhi's son-in-law, Robert Vadra and real estate giant DLF.

The allegations were leveled by India Against Corruption (IAC) leader Arvind Kejriwal and Supreme Court advocate Prashant Bhushan last week. Kejriwal and Bhushan have alleged that Vadra had been hugely favoured by realty major DLF, a charge denied by both. They alleged that Vadra had bought property worth crores of rupees between 2007 and 2010 with an unsecured interest free loan of Rs 65 crore given by DLF.

On Thursday, a division bench comprising Justice Uma Nath Singh and Justice V K Dixit heard the petition filed by a social activist, Nutan Thakur. She had prayed for the prime minister's office to conduct an enquiry in the allegations against Vadra, on the merit of the facts submitted by her in the petition.

The court also heard Additional Solicitor General Ashok Nigam, representing the central government. He strongly opposed the petition saying it was based on hearsay and was not maintainable. The court then asked Nigam to plead objections on affidavit, for which he sought three weeks time to file objections.The next hearing of the case is on November 21.

Before filing the petition, Thakur had sent a representation to the Prime Minister enclosing the various allegations made by Kejriwal. She had said that despite specific denials by DLF and Vadra, some of the basic questions remain completely unanswered.

One such question is how could a company with an initial investment of Rs 50 lakh be worth Rs 500 crore today. According to the petitioner, it is imperative that the government of India enquires into these serious allegations through Income Tax, Enforcement Directorate and other appropriate authorities. She had also requested for the government to officially release the facts pertaining to the case.

In her petition, Thakur has named the government of India including home secretary, finance secretary and Central Bureau of Investigation (CBI) as the respondents in the case.

The petition has been filed under Article 226 of the Constitution of India. Thakur has asked for the petition to be processed within a reasonable period. There should be a decision within 30 days of receiving the representation or the order of the court, whichever is received later.

Thakur, in her petition has said since Vadra is the son-in-law of the president of a ruling political party, it is the duty of the government of India to explain itself.
